MagniFly

Terms

These are our terms: a shared umbrella that protects you and me. The short version first, then section by section.

§ 1. General provisions and definitions

  1. These terms govern the use of magnifly.services (the "Site") and the services provided by Mateusz Tomczak, trading as MagniFly, e-mail mattomczak.vipfa@gmail.com ("MagniFly", the "Provider", "I").
  2. In these terms:
    1. Client ("you") means a natural person, legal person or organisational unit using MagniFly's services;
    2. Consumer means a Client who is a consumer within the meaning of Art. 221 of the Polish Civil Code ("KC"), and a natural person concluding a contract directly connected with their business where the contract is not of a professional nature for them (Art. 3855 KC);
    3. Pilot means a person holding a valid pilot licence and medical certificate who flies as pilot-in-command;
    4. Operator means an air carrier or operator authorised to conduct the type of flight concerned, in particular the holder of an air operator certificate (AOC);
    5. Cost-shared flight means a non-commercial flight under Art. 6(4a)(a) of Commission Regulation (EU) No 965/2012, the direct costs of which are shared by all the occupants of the aircraft, the pilot included, with no more than six persons sharing them;
    6. Booking fee means MagniFly's remuneration for arranging a flight as an intermediary, paid when booking;
    7. Cost estimate means the indicative cost of a flight shown on the Site by the pricing assistant (a calculator), worked out from the Client's data and typical rates;
    8. Confirmation means an e-mail from MagniFly naming, for a flight, the pilot or the operator, the date and the binding cost;
    9. Contract confirmation means the e-mail sent after payment with the content of the contract, generated from the data the Client gave when ordering, and these terms attached as a PDF file.
  3. MagniFly provides: (a) freelance cabin crew for operators and owners of aircraft; (b) arranging flights as an intermediary: scenic flights, cost-shared flights (air taxi), transfers and charter; (c) intermediation in the purchase and sale of aircraft; (d) peer-to-peer preparation for cabin crew recruitment (flight attendant, stewardess or steward, air hostess or air host).
  4. Contracts with MagniFly are contracts for services to which the provisions on mandate apply accordingly (Art. 750 in connection with Art. 734 et seq. KC), unless a separate agreement provides otherwise.

§ 2. Scope of intermediation

  1. For flights, MagniFly acts solely as an intermediary: it finds a pilot or an operator, agrees the date and terms of the flight, passes on information and coordinates the preparations. MagniFly is not an air carrier or an aircraft operator, does not perform flights and is not a party to the contract of carriage concluded with an operator or to the cost-sharing arrangement made with a pilot.
  2. The flight is the performance of the pilot or the operator, not of MagniFly; the pilot and the operator are not persons through whom MagniFly performs its obligation within the meaning of Art. 474 KC. The operator flies under its own conditions of carriage, and the pilot in accordance with aviation law.
  3. Whether a flight takes place, is delayed, interrupted or re-routed, or whether a passenger is refused, is decided by the pilot-in-command, in particular for reasons of safety, weather, the technical condition of the aircraft, mass and balance or the passenger's condition. Such a decision is not non-performance or improper performance by MagniFly. The weather forecast shown when booking (data of MET Norway and NOAA) is indicative and does not decide whether a flight takes place.
  4. In the purchase and sale of aircraft, MagniFly introduces the parties and coordinates the process. It is not a party to the sale contract, does not sell aircraft in its own name and does not carry out technical inspections, valuations or legal opinions; these are carried out by specialists named to you under separate contracts.
  5. Interview preparation is a conversation between colleagues and training. It is not job placement, therapy or legal advice; the decision to hire rests solely with the airline.

§ 3. Booking, conclusion of the contract and payments

  1. Services are ordered on the Site: you choose the service, the date or days and the details, confirm that you have read and accept these terms, and pay through the payment page of Stripe or of a crypto payment provider, or by bank transfer on a pro forma invoice. Before paying, you see the total amount and what it covers. Clicking "Reserve and pay" places an order with an obligation to pay (Art. 17(3) of the Polish Consumer Rights Act of 30 May 2014, "UPK").
  2. The contract is concluded when you pay (for a bank transfer or a crypto payment: when the payment is credited or confirmed on the network). Its content is these terms and the data you gave when ordering. Without undue delay after the payment I send the Contract confirmation to the e-mail address you gave; it is the confirmation of a distance contract on a durable medium (Art. 21 UPK).
  3. For flights, after the payment I agree the date with the pilot or the operator and send you the Confirmation, no later than 3 working days after payment. If no pilot or operator can fly on your date and we do not agree another, I refund the whole payment within 7 days.
  4. Cabin crew services are booked for the days chosen on the Site and paid in advance, in full or, if you choose, in two parts: a deposit when booking and the rest on a pro forma invoice before the first day (§ 6). Finding an aircraft for a buyer starts with the retainer paid on the Site (§ 7). A contract for intermediation in the sale of an aircraft is concluded when the Client accepts, by e-mail, the contract sent to them (documentary form); nothing is paid upfront (§ 7).
  5. Prices on the Site are final prices. They are set in Polish złoty, the cabin crew rate in euro; the Site also shows them in EUR, GBP and USD, converted at the fixed rate stated on the Site and rounded up. The amount in the currency you pay in is the price of the contract. Some payment methods depend on the currency (BLIK only in złoty).
  6. You may pay in cryptocurrency (Bitcoin, USDC or Monero) through the crypto payment page, which sets the amount in the coin at the current rate for the price in your currency; network fees are paid by the sender. A refund of a crypto payment is made in the same coin to an address you give, for the amount in the currency of the contract, or by bank transfer if we agree.
  7. Refunds go to the same payment method unless we agree another, at no extra cost to you. I issue an invoice after payment, on request with the tax ID you give.

§ 4. Booking fee, cost estimate and changes to a flight

  1. The Booking fee is MagniFly's remuneration for intermediation: finding a pilot or an operator for your date, agreeing the terms of the flight and sending you the Confirmation naming the pilot or the operator, the date and the cost of the flight. The intermediation service is performed when that Confirmation is sent.
  2. The Booking fee is not part of the cost of the flight and does not go to the pilot. You settle the costs of a Cost-shared flight directly with the pilot: they are split equally between everyone on board, the pilot included, with no profit for the pilot.
  3. For a charter, my remuneration is 10% of the price of the flight in the operator's quote you choose, and no less than PLN 3,200. The Booking fee is part of it: you pay it when booking, for obtaining operators' quotes for your route and date. You pay the rest of my remuneration in advance, when you accept the quote and before the flight; I state it in the Confirmation separately from the operator's price. The price and terms of the charter are set by the operator's quote, and you conclude the contract of carriage with the operator. If I present no quote for your route, date and number of people (for example when no aircraft is available then), I refund the whole Booking fee. If you receive quotes and choose none of them, the Booking fee remains my remuneration for obtaining them, subject to point 4.
  4. The Cost estimate is indicative and is not an offer within the meaning of Art. 66 § 1 KC. The binding cost of the flight is given by the pilot or the operator and passed on in the Confirmation. If that cost is more than 15% above the Cost estimate shown when you booked, you may, within 48 hours of receiving the Confirmation (for a charter: of receiving the quotes, before you accept one), cancel the flight and receive the whole Booking fee back. This does not apply where the higher cost results from changes you asked for (number of people, route, flight time, baggage, date).
  5. If the flight cannot take place for reasons you are not responsible for (weather, the pilot's safety decision, the technical condition of the aircraft, airspace restrictions, the pilot or the operator being unavailable, reasons on my side), you choose: a new date, which I arrange at no extra fee, or a refund of the whole Booking fee and, for a charter, of the rest of my remuneration.
  6. If you cancel the flight after receiving the Confirmation, the Booking fee and, for a charter, the rest of my remuneration are not refunded, because the intermediation service has been performed. If you tell me at least 48 hours before the flight, I move it once, free of charge, to another date agreed with the pilot or the operator. Costs already incurred by the operator (for example positioning or catering) are settled under the operator's terms.
  7. If the flight does not take place for reasons on your side, in particular lateness, missing documents, untrue data on the number or mass of passengers and baggage, being under the influence of alcohol or drugs, not following the pilot's instructions or behaviour endangering safety, the Booking fee and, for a charter, the rest of my remuneration are not refunded and you bear the costs incurred by the pilot or the operator to the extent their terms provide.
  8. Charter extras are ordered when booking or later and paid together with the rest of my remuneration, when you accept the quote:
    1. a return flight or next leg booked together with the charter: my remuneration on the price of that leg is 7% instead of 10%;
    2. steward on board: at your request and with the operator's agreement I fly as the cabin attendant on your charter; the day rate is then 25% lower (€338 instead of €450) for every day from departure to return, with the per diem unchanged (€75); § 6 points 4 and 6 apply;
    3. airport coordination: PLN 390 per leg; airport charges and outside services (for example a VIP lounge or fast track) are passed on at cost, with no mark-up.
    If the flight does not take place for reasons you are not responsible for, I refund the whole payment for the extras.
  9. I obtain operators' quotes for you through my work and contacts. If within 12 months of receiving them you book, without me, yourself or through someone else, a flight with an operator whose quote I presented, on the same route (also in the opposite direction or from a nearby airport), I am entitled to the remuneration in point 3, less the Booking fee paid, as if the flight had been booked through me. Putting off the booking or drawing out talks with the operator only so that the 12 months pass changes nothing: the remuneration is then due as if the flight had been booked within that period. Flights with that operator on other routes you book with no obligation to me.
  10. "Book me too" at a scenic flight or an air taxi: at your request I come to the airfield, meet you there, look after the details on the ground (the pilot, the timing, the briefing, anything you arranged with me for the occasion) and stay until you land. The price is shown on the Site (PLN 290) and is paid together with the Booking fee; it is refunded on the same terms as the Booking fee (points 4 to 6). Costs of outside services ordered for you (for example flowers or a photographer) are agreed separately and passed on at cost.

§ 5. Your obligations on a flight

  1. You give true and complete data: the number and names of passengers, their approximate mass, baggage and circumstances relevant to safety, including medical contraindications.
  2. You carry an identity document and, on international flights, a document entitling you to cross the border.
  3. You arrive at the airfield at the agreed time and follow the instructions of the pilot and the airfield staff; you carry no dangerous goods.
  4. A minor flies with a parent or guardian or with their written consent; the pilot decides about carrying the youngest passengers and how they are secured.

§ 6. Cabin crew services

  1. I provide cabin crew services to operators and owners of aircraft for the days booked on the Site or agreed in writing. The day rate and the per diem are shown on the Site (€450 and €75 a day); the booked days are paid in advance, in full or in two parts under point 2.
  2. If the first booked day is at least 7 days away, you may pay, when booking, a deposit of at least 50% of the price of the booked days (day rate and per diem; the Site shows the amount), and the rest by bank transfer on the pro forma invoice I send with the Contract confirmation, no later than 3 days before the first booked day. If the rest has not been credited by then, I may release the booked days; the payment made is then settled under point 5 as if you had cancelled the days on that date.
  3. The positioning ticket to and from the aircraft is booked by the Client, or by me and reimbursed by the Client at cost against the receipt within 7 days. Accommodation away from base and ground transport are provided by the Client.
  4. The operator retains operational control over the flight and is responsible for the required familiarisation with the type and the operator's procedures and for insurance. Duty and rest times follow the operator's flight time limitations. I perform my duties with the diligence required of a professional (Art. 355 § 2 KC).
  5. If the Client cancels booked days, the cancellation fee is: nothing for a cancellation more than 7 days before the first day; half the price of the cancelled days for a cancellation from 7 days to 48 hours before; their whole price for a cancellation less than 48 hours before the first day. I refund whatever was paid beyond the fee. If I cannot work for reasons on my side, I refund the whole payment for the days not worked.
  6. Everything I learn in connection with a flight is kept confidential without time limit, unless the law requires disclosure; on request I sign a separate non-disclosure agreement (NDA).

§ 7. Purchase and sale of aircraft

  1. Finding an aircraft for a buyer: you give the criteria and the search period on the Site and pay the retainer shown there. The retainer counts towards my success fee of 3% of the purchase price, due when you conclude the purchase contract for an aircraft I presented. If within the search period I present no offer that meets the criteria, I refund the whole retainer.
  2. Selling a client's aircraft: a non-exclusive contract for 6 months with nothing paid upfront; my success fee is 5% of the sale price, no less than PLN 10,000, due when you conclude the sale contract with a buyer I introduced.
  3. If within 12 months of an introduction you conclude a transaction concerning an aircraft with a person or entity I introduced (or an entity related to them), I am entitled to the remuneration set in the contract as if the transaction had been concluded with my involvement.
  4. Information about an aircraft comes from the seller or third parties; I pass it on with due diligence but do not guarantee its accuracy. I am not responsible for the technical condition, airworthiness, documentation, legal status (including encumbrances), valuation, financing or tax consequences of a transaction; before buying, I recommend a pre-buy inspection and a title check by independent specialists.

§ 8. Interview preparation and the question pack

  1. Two things are on offer, at the prices shown on the Site: (a) the "Open-day question pack": 49 interview questions with hints (what the recruiter checks, how to build the answer), the story bank and the practice mode with a timer, in the member area (§ 9), as digital content opened right after payment, with access for 12 months from purchase; (b) the "Complete preparation" package: a CV for the airline of your choice; that airline's grooming guidelines; an assessment day rehearsal (group task, one-minute pitch, final interview); the question pack, made available before the session; a debrief after the recruitment; and access to the member area (§ 9) for 12 months.
  2. If you bought the question pack and order the Complete preparation within 12 months, the price of the pack is deducted: tell me when booking, and I refund it to the same payment method within 14 days of the booking.
  3. The second-rehearsal guarantee: if, after the Complete preparation, the airline you prepared for does not hire you at the assessment you attended, I prepare you for your next assessment, at that airline or another, within 12 months of our first session: one more rehearsal (group task, pitch, final interview) and one more debrief, at no extra charge. It applies once and requires that you attended the assessment; it does not change point 7.
  4. Sessions are held online or in person. You use the package within 6 months of booking; this period is extended by any time lost to changes on my side.
  5. Up to 24 hours before a session I confirm the time or offer a new one. A session may be moved because of circumstances beyond my control or a client who suddenly needs me on a flight; you then choose a new date from those I offer. If none of them suits you within 30 days, I refund the part of the price corresponding to the elements of the package not yet provided.
  6. You may change the date of a session free of charge if you tell me at least 24 hours before it. A session cancelled later or missed because you did not attend counts as held, unless the cause was illness, an accident or another sudden reason you tell me about without delay; we then set a new date.
  7. Preparation improves your chances but does not guarantee employment; the airline's decision is not non-performance or improper performance of the service.
  8. The questions, hints and materials are works protected by the Polish Copyright Act of 4 February 1994. You receive a non-exclusive, personal licence to use them for your own recruitment, without the right to share, copy, publish or resell them.

§ 9. Member area and private links

  1. The member area and the portfolio are opened through a personal link sent by e-mail. The link is assigned to its recipient and may not be shared; the content may be marked with the recipient's name or e-mail address.
  2. Copying, downloading, recording, taking screenshots of and distributing content made available through a link is prohibited, except for permitted personal use within the limits of the law.
  3. A member-area link is valid for 12 months from booking and a portfolio link for 30 days, unless the message with the link states otherwise. If paragraph 1 or 2 is breached, I may block the link; claims under copyright law are reserved.
  4. The portfolio is made available solely to assess cooperation with MagniFly; its content is confidential.

§ 10. Communication

  1. Binding arrangements, in particular the date, scope, cost and any changes, are confirmed by e-mail.
  2. On request, we talk on end-to-end encrypted messengers that keep no message history. Because such conversations are not archived, binding arrangements are confirmed by e-mail.

§ 11. Liability

  1. MagniFly is liable for the proper performance of its own services with the diligence required of a professional (Art. 355 § 2 KC), within the scope described in these terms and in the Confirmation.
  2. MagniFly is liable for the careful selection of the pilot or the operator: before an introduction I check documents confirming the pilot's valid licence, medical certificate and the privileges required to carry passengers, and the operator's authorisation for the type of flight.
  3. Beyond paragraphs 1 and 2, MagniFly is not liable for: (a) acts and omissions of pilots, operators, airports, air traffic services, airlines, buyers and sellers of aircraft and other third parties; (b) decisions of the pilot-in-command (§ 2(3)), weather, airspace restrictions, strikes and decisions of authorities; (c) the technical condition and airworthiness of aircraft; (d) the outcome of a recruitment; (e) the outcome, price and consequences of transactions concerning aircraft; (f) the consequences of untrue or incomplete data given by the Client.
  4. Towards Clients who are not Consumers, MagniFly's liability is limited to the remuneration received for the service to which the claim relates and does not cover lost profits. This limitation does not apply to damage caused intentionally (Art. 473 § 2 KC).
  5. Towards Consumers, this section does not exclude or limit MagniFly's liability for personal injury or for non-performance or improper performance of its own obligations to the extent that mandatory law, in particular Art. 3853 KC, prohibits it.

§ 12. Force majeure

Neither party is liable for non-performance or improper performance caused by force majeure, an external event that could not be foreseen or prevented (for example weather preventing a flight, closure of airspace, decisions of authorities, strikes, epidemics, natural disasters). While it lasts, the parties' obligations are suspended and the parties set a new date. If none can be set within 60 days, I refund payments for services not performed (Art. 495 § 1 KC).

§ 13. Right of withdrawal (Consumers)

  1. A Consumer may withdraw from a distance contract within 14 days of its conclusion without giving a reason (Art. 27 UPK) by sending a statement by e-mail to mattomczak.vipfa@gmail.com; the model form in Annex 2 to the UPK may be used. The refund is made within 14 days of receiving the statement (Art. 32 UPK).
  2. When you book and pay on the Site, you tick a box in which you ask for the service to start before the withdrawal period ends and acknowledge that you will lose the right of withdrawal once the service has been fully performed (Art. 38(1)(1) UPK). If you withdraw after the service has started, you pay for what was provided up to the withdrawal, in proportion to its scope (Art. 35 UPK).
  3. The question pack (§ 8(1)(a)) is digital content not supplied on a tangible medium. When buying it you ask for it to be delivered before the withdrawal period ends and acknowledge that you thereby lose the right of withdrawal (Art. 38(1)(13) UPK); I confirm this in the Contract confirmation. The right of withdrawal also does not apply in the other cases listed in Art. 38 UPK, in particular to services connected with leisure where the contract specifies the date of performance (Art. 38(1)(12) UPK).
  4. A contract for the carriage of passengers concluded with an operator is subject to the UPK only as regards Art. 7a, 10, 11 and 17 (Art. 3(1)(4) UPK); it is governed by the operator's conditions of carriage and aviation law.

§ 14. Complaints

Send complaints by e-mail to mattomczak.vipfa@gmail.com, describing what they concern and what you ask for. I reply within 14 days of receipt (Art. 7a UPK). Consumers may use out-of-court dispute resolution, in particular the help of a municipal or district consumer ombudsman or a regional inspectorate of the Trade Inspection (uokik.gov.pl).

§ 15. Personal data (GDPR)

  1. The controller of the personal data of Clients and of people who write to me is the Provider, Mateusz Tomczak, e-mail mattomczak.vipfa@gmail.com. I process data under Regulation (EU) 2016/679 (GDPR) and the Polish Act of 10 May 2018 on the Protection of Personal Data.
  2. Purposes and legal bases: answering a request, preparing an offer and performing the contract (Art. 6(1)(b) GDPR); invoicing and keeping accounts (Art. 6(1)(c)); pursuing or defending claims, keeping the Site secure and following up on a request you made (my legitimate interest, Art. 6(1)(f)); the newsletter and visit statistics only with your consent (Art. 6(1)(a)), which you may withdraw at any time without affecting what was done before.
  3. Giving data is voluntary, but without a name and a way to reach you I cannot answer, and without the data the contract requires I cannot perform it.
  4. Recipients, only as far as needed: the hosting provider of the Site, the e-mail provider, the payment provider (Stripe, a separate controller for card data), the service that delivers forms to my mailbox, the newsletter tool when enabled, and, once you book, the pilot or air operator performing the flight (route, date, number of passengers and the lead passenger's name as required by law) or, for cabin crew services, the operator you book me for. Some providers process data outside the EEA under standard contractual clauses or an adequacy decision.
  5. Retention: requests that lead to no booking, up to 12 months after our last contact; bookings and contracts, for as long as tax and accounting law requires (in Poland 5 years from the end of the tax year) and for the limitation period of claims; the newsletter, until you unsubscribe.
  6. You have the right of access, rectification, erasure, restriction, portability and objection (Art. 15–21 GDPR), and the right to lodge a complaint with a supervisory authority (in Poland the President of the Personal Data Protection Office, uodo.gov.pl, or the authority in your country). I don't profile you and I make no automated decisions about you.
  7. Details, including the map service, the weather data and the approximate location used by the airfield map, are in the privacy policy, which forms part of these Terms.

§ 16. Cookies and browser storage

  1. The Site uses only what it needs to work: browser storage for the language, the currency, the music switch, an unsent form and an order in progress, and in the member area and the portfolio a login cookie set when you open a personal link. These do not require consent (Art. 173(3) of the Polish Telecommunications Law and the corresponding provision of the Electronic Communications Law): they are what you asked the Site to do.
  2. Tools that measure visits (currently Cloudflare Web Analytics, which uses no cookies and no profiling) run only after you choose "Accept" in the cookie notice; "Only what is needed" or no choice keeps them off. Your choice is kept in your browser for 12 months and can be changed from the "Cookies" link in the footer or in your browser's settings.
  3. Which cookies and storage are used, by whom and for how long is listed in the privacy policy.

§ 17. Intellectual property

  1. The texts, photographs, materials and layout of the Site are protected by copyright; copying and using them without consent is prohibited, except for permitted use.

§ 18. Final provisions

  1. I may change these terms for important reasons (changes in the law, new services, technical changes). A change applies to contracts concluded after its publication; contracts concluded earlier are performed under the version in force on the day they were concluded.
  2. Polish law applies. A Consumer habitually resident in another country keeps the protection of the mandatory provisions of that country (Art. 6(2) of Regulation (EC) No 593/2008).
  3. Disputes with Clients who are not Consumers are settled by the court competent for the Provider's place of residence.
  4. If any provision proves invalid or ineffective, the remaining provisions continue to bind.
  5. These terms apply from 24 October 2026.
